MEMBERSHIP TERMS AND CONDITIONS

1. INTRODUCTION
These Membership Terms and Conditions ("Terms") govern your membership with Emerald Support Welcome Centre CLG ("we," "us," "our," or "the Organisation"), a company limited by guarantee incorporated in Ireland (Company Number: 796762).
By applying for and accepting membership, you agree to be bound by these Terms, our Constitution, and all applicable rules and policies of the Organisation.
IMPORTANT: Please read these Terms carefully before becoming a member. If you do not agree with any part of these Terms, you should not apply for membership.
2. DEFINITIONS
"Member" means any person or organisation admitted to membership in accordance with these Terms and the Constitution.
"Membership Fee" means the monthly or annual subscription fee payable by Members as set out in these Terms.
"Enrolment Fee" means the one-time fee paid upon initial registration as a Member.
"Services" means the immigration support, document preparation, advocacy, and other assistance provided by the Organisation to Members and the public.
"Constitution" means the Constitution and Memorandum of Association of Emerald Support Welcome Centre CLG.
3. MEMBERSHIP TYPES AND FEES
3.1 Membership Tiers
The Organisation offers five (5) types of membership:
a) Standard Membership
• Enrolment Fee: €10 (one-time)
• Monthly Fee: €10
• Eligibility: Employed individuals
b) Concession Membership
• Enrolment Fee: €10 (one-time)
• Monthly Fee: €5
• Eligibility: Unemployed individuals, asylum seekers, international protection applicants, or those earning less than €500/month
• Proof Required: Jobseeker's letter, Direct Provision letter, social welfare documentation, or statutory declaration (verified annually)
c) Hardship Membership
• Enrolment Fee: €0 (waived)
• Monthly Fee: €0 (waived)
• Eligibility: Individuals experiencing extreme financial hardship
• Review Period: Renewable every 6 months subject to review
d) Family Membership
• Enrolment Fee: €15 (one-time)
• Monthly Fee: €15
• Eligibility: Two (2) or more adults residing in the same household
• Coverage: All adults in the household
e) Organizational/Corporate Membership
• Annual Fee: €200 (paid annually)
• Eligibility: Businesses, non-governmental organizations, community organizations, and corporate entities
3.2 Fee Payment and Due Dates
3.2.1 Enrolment fees are due and payable upon application for membership.
3.2.2 Monthly membership fees are due on the same date each month as the date of initial membership activation.
3.2.3 Annual membership fees (Organisational) are due on the anniversary of membership commencement.
3.2.4 Fees may be paid by:
• Online payment via Joinit.com
• Bank transfer
• Cash (in person at our office)
• Debit/credit card
3.3 Fee Changes
3.3.1 The Organisation reserves the right to change membership fees upon thirty (30) days' written notice to all Members.
3.3.2 Fee changes will not apply to prepaid annual memberships until renewal.
4. NON-REFUNDABLE FEES AND DONATIONS
4.1 All Fees Are Non-Refundable
ALL MEMBERSHIP FEES, INCLUDING BUT NOT LIMITED TO ENROLMENT FEES AND MONTHLY/ANNUAL SUBSCRIPTION FEES, ARE STRICTLY NON-REFUNDABLE UNDER ANY CIRCUMSTANCES.
This includes, without limitation:
• Enrolment fees paid upon application
• Monthly membership fees already paid
• Annual membership fees already paid
• Fees paid in advance
• Fees paid in error
• Fees paid by third parties on your behalf
4.2 No Refunds Upon Cancellation
If you cancel your membership for any reason, you will NOT receive a refund of:
• Your enrolment fee
• Any membership fees already paid for the current billing period
• Any prepaid fees for future periods
However, upon cancellation, you will not be charged for subsequent billing periods.
4.3 Donations Are Non-Refundable
ALL DONATIONS MADE TO THE ORGANISATION ARE FINAL AND NON-REFUNDABLE.
By making a donation, you acknowledge and agree that:
• Donations are voluntary contributions
• Donations are made without expectation of goods or services in return
• Donations cannot be reversed, refunded, or reclaimed
• The Organisation is not obligated to return donations under any circumstances
4.4 Acknowledgment
By completing membership registration and payment, you explicitly acknowledge and agree that you have read, understood, and accept this non-refundable policy.
5. MEMBERSHIP APPLICATION AND ADMISSION
5.1 Application Process
5.1.1 All prospective Members must complete an application form (online via Joinit.com or paper form).
5.1.2 Applications must include accurate and complete information. Providing false or misleading information may result in membership denial or termination.
5.1.3 Payment of the enrolment fee and first membership fee is required upon application.
5.2 Admission Approval
5.2.1 The Board of Directors reserves the right to approve or reject any membership application in its sole discretion.
5.2.2 Standard, Concession, and Family memberships are normally approved automatically upon payment.
5.2.3 Hardship memberships require Board approval and verification of financial hardship.
5.2.4 Organizational memberships require Board approval.
5.3 Membership Activation
5.3.1 Membership is activated immediately upon approval and payment.
5.3.2 Members will receive a welcome email with membership details within 24 hours of activation.
5.3.3 A membership number will be assigned to each Member.
6. MEMBER BENEFITS
6.1 Standard Benefits (All Members)
All Members, regardless of tier, receive:
• Priority service (reduced wait times)
• Monthly newsletter with immigration updates
• Invitations to member events and workshops
• Access to member-only resources and information
• Voting rights at the Annual General Meeting (individual members only)
• Community connection and networking opportunities
6.2 Free Services for Unemployed Members
Concession and Hardship Members receive ALL of the following services at no additional charge:
• International Protection Office (IPO) applications
• International Protection Appeals Tribunal (IPAT) appeals
• Section 22 (Leave to Remain) applications
• Judicial Review support and legal referrals
• All document preparation and form completion
• All letter writing and official correspondence
• Translation coordination
• Integration support and guidance
• Advocacy and representation (non-legal)
6.3 Service Limitations
6.3.1 The Organisation is NOT a law firm and does NOT provide legal representation in court.
6.3.2 Services are subject to staff availability and capacity.
6.3.3 The Organisation reserves the right to refer Members to external service providers (e.g., Legal Aid Board, solicitors) when appropriate.
6.3.4 Services do not include court representation, legal advice, or practice of law.
7. EMPLOYMENT STATUS CHANGES
7.1 Gaining Employment (Concession to Standard)
7.1.1 Concession Members who gain employment must notify the Organisation within thirty (30) days.
7.1.2 Grace Period: Members who gain employment will continue at the Concession rate (€5/month) for the first two (2) months of employment.
7.1.3 From the third (3rd) month of employment, the monthly fee automatically increases to the Standard rate (€10/month).
7.1.4 Part-time employment (less than 20 hours per week OR earning less than €500/month) does NOT require a tier change.
7.2 Losing Employment (Standard to Concession)
7.2.1 Members who lose employment may immediately revert to Concession membership upon notification and verification.
7.2.2 The monthly fee will be reduced to €5/month from the next billing cycle.
7.2.3 Free services will be activated immediately upon tier change.
8. MEMBER OBLIGATIONS
As a Member, you agree to:
8.1 Pay all membership fees when due and payable.
8.2 Abide by the Constitution and all rules, policies, and decisions of the Organisation.
8.3 Conduct yourself in a manner consistent with the values and mission of the Organisation.
8.4 Provide accurate and truthful information in all dealings with the Organisation.
8.5 Notify the Organisation promptly of any changes to your contact information, employment status, or eligibility for membership tier.
8.6 Treat staff, directors, volunteers, and other Members with respect and dignity.
8.7 Not engage in any conduct that brings the Organisation into disrepute.
8.8 Comply with all applicable Irish laws and regulations.
9. MEMBERSHIP TERMINATION
9.1 Voluntary Termination by Member
9.1.1 Members may cancel their membership at any time by written notice (email acceptable) to membership@emeraldsupportwelcomecentre.ie.
9.1.2 Cancellation takes effect at the end of the current billing period.
9.1.3 No refunds will be provided upon voluntary termination (see Section 4).
9.1.4 Members who cancel may reapply for membership at any time, but must pay a new enrolment fee.
9.2 Termination for Non-Payment
9.2.1 If a membership fee remains unpaid for thirty (30) days after the due date, the Organisation may suspend the Member's benefits.
9.2.2 If payment remains outstanding for sixty (60) days, membership may be terminated automatically.
9.2.3 The Organisation will provide notice before suspension or termination.
9.3 Termination by the Organisation
9.3.1 The Board of Directors may terminate any membership immediately for:
• Breach of these Terms or the Constitution
• Providing false or fraudulent information
• Abusive, threatening, or inappropriate conduct toward staff, directors, volunteers, or other Members
• Conduct that brings the Organisation into disrepute
• Violation of Irish law
• Any other serious misconduct
9.3.2 The Organisation will provide written notice of termination with reasons (unless circumstances make this impractical).
9.3.3 No refunds will be provided upon termination by the Organisation.
10. DATA PROTECTION AND PRIVACY
10.1 The Organisation processes your personal data in accordance with the General Data Protection Regulation (GDPR) and Irish Data Protection legislation.
10.2 Our full Privacy Policy is available at www.emeraldsupportwelcomecentre.ie/privacy-policy.
10.3 By becoming a Member, you consent to the processing of your personal data as described in our Privacy Policy.
10.4 You have the right to access, correct, delete, or restrict the use of your personal data. Contact us at info@emeraldsupportwelcomecentre.ie to exercise these rights.
11. LIMITATION OF LIABILITY
11.1 The Organisation provides immigration support and advocacy services on a best-efforts basis.
11.2 The Organisation does NOT guarantee any specific outcome in immigration matters, including but not limited to approval of applications, success in appeals, or favorable decisions from government authorities.
11.3 To the fullest extent permitted by Irish law, the Organisation shall not be liable for:
• Delays in processing caused by government authorities
• Rejection or refusal of applications
• Changes in immigration law or policy
• Indirect, incidental, or consequential damages
• Any damages arising from use of our Services
11.4 Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
12. AMENDMENTS TO THESE TERMS
12.1 The Organisation reserves the right to amend these Terms at any time.
12.2 Members will be notified of material changes via email at least thirty (30) days before the changes take effect.
12.3 Continued membership after the effective date of changes constitutes acceptance of the amended Terms.
12.4 The current version of these Terms is always available at www.emeraldsupportwelcomecentre.ie/membership-terms.
13. GOVERNING LAW AND JURISDICTION
13.1 These Terms are governed by and construed in accordance with the laws of Ireland.
13.2 Any disputes arising from these Terms or membership shall be subject to the exclusive jurisdiction of the Irish courts.

By applying for membership and completing payment, you acknowledge that you have read, understood, and agree to be bound by these Membership Terms and Conditions, including the non-refundable fee policy.
